Policy
Livingston County Michigan Works! (LCMW) and its service providers will make "reasonable accommodations" to the known physical or mental limitations of otherwise qualified individuals with disabilities, unless it can be shown that the accommodations would impose an undue financial or administrative burden. This policy applies to program applicants, program participants/registrants, the general public, all employees of LCMW and its service providers, and all applicants for jobs at LCMW and its service providers.
LCMW assures that:
- Local procedures will be modified, as necessary, to ensure that an accommodations request can be made;
- Restructure job or training programs needed;
- Develop modified work or training schedules as needed;
- Alter assessment/testing techniques that prevent the fair evaluation of skills needed;
- Provide auxiliary aids and services as needed;
- Acquire or modify equipment or devices as needed; and
- Make necessary alterations to the work or training site to ensure that facilities are accessible to individuals with disabilities.
The LCMW and its recipients ensures the dissemination of both public and internal notice of the accommodations process.
Processing Accommodation Requests
This process applies to program applicants, program participants/registrants, and the general public.
Requests for reasonable accommodation should be submitted in writing to any LCMW or service provider staff. The request should state the nature of the accommodation being sought, the reason why the accommodation is needed, and the approximate cost of the accommodation, if known. All requests will be forwarded to the LCMW EO officer. The EO officer will log the request and prepare a response. A written response to a request will be issued promptly, but not more than one week after receipt of the request.
In responding to written requests for reasonable accommodations. Livingston County Michigan Works! (LCMW) is not required to take any action that it demonstrates would result in fundamental alteration in the nature of its program activity or in undue financial or administrative burden. LCMW has the burden of providing such alteration or if a burden exists after considering all resources for use in the operation of the federally funded program, activity or service. Such determinations must:
- be made by the LCMW Director or his/her designee; and
- be accompanied by a written statement of the reasons for reaching that conclusion.
LCMW must further provide a copy of the written determination to the individual requesting the accommodation. The determination that a requested accommodation would result in an undue financial or administrative burden does not relieve LCMW from the duty to furnish an alternative accommodation or service, if available, that would not result in an undue financial or administrative burden.
Employees of LCMW and applicants for jobs at LCMW will follow the process established by the County of Livingston for requesting reasonable accommodations. Employees of service providers at the Michigan Works! Livingston Service Center will follow the process of their employer for requesting reasonable accommodations.
